The court assessed a notification by the Assam Government which called for setting up of Thana Level Committees. It was held that here was no scope for such a Committee after the Illegal Migrants (Determination by Tribunals) Act, 1983 rules therein were declared unconstitutional. It would have no legal force and no legal authority to accept petitions relating to illegal migrants and thereafter to examine and verify the same. The notification was based on a fallacious premise by providing for members, belonging to majority community, religious minority community and linguistic minority community. The question of citizenship "has to be determined strictly in accordance with law where Thana Level Committees can have no role or locus-standi. "
