Following Sarbananda Sonowal v. Union of India, which struck down the Illegal Migrants (Determination by Tribunals) Act, 1983 as unconstitutional, the question was whether all matters under this Act be taken up by the Foreigners' Tribunals under the Foreigners' Act, 1946. The court held that in fairness and following principles of natural justice, all writ petitions should be remanded to the Foreigners' Tribunals for fresh proceedings.
