Summary/Remarks
The petitioner had argued that the Influx from Pakistan (Control) Ordinance, 1948 was ultra vires of the powers of the Governor General. The court disagreed and held that the Section 6 of the Indian Independence Act provides powers to the Dominion Legislature to legislate, including powers to make laws having extra-territorial operation. During Emergencies, the Governor General would have the same powers.
