The petitioner had argued that the (Influx from West Pakistan (Control) Ordinance, 1948, was not applicable to the state of Saurashtra. It had been argued that the Instrument of Accession gave such authority only to the Dominion Legislature. The court found that Instrument of Accession, delegates to the Governor General the legislative power contained in Section 42 of the Government of India Act, 1935 by issue of Ordinances.
