It was held that Section 7 of the Influx from Pakistan (Control) Act, 1949 was void since it infringed the rights under Article 19(1)(a) of the Constitution. It was held that the purpose of the Act is not to remove citizens from India but rather to control the admission of people into India from Pakistan.
