Summary/Remarks

It was held that if a Muslim against whom proceedings are commenced under the Administration of Evacuee Property Act, 1950, for declaring him an evacuee, and for declaring his properties evacuee properties, dies during the pendency of the proceedings then he cannot be declared an evacuee after his death. His properties shall vest in his heirs upon his death under the Muslim law of succession and they cannot be declared evacuee properties.
