The court held that: (1) All Rules and actions taken under Influx from Pakistan (Control) Ordinance (No. XXXIV of 1948) were saved by Section 9(2) of the Influx from Pakistan (Control) Act, 1949, even though Section 9 repeals the ordinance. (2) The Ordinance was applicable to the erstwhile state of Kotah, since the Mahrao of Kotah had signed the Instrument of Accession, giving binding effect to the legislation of the Dominion Legislature and the Governor-General.
