The court held that: (1) The term "domicile" in Rule 31 of the Permit System Rules, 1949 was not limited to just acquired domicile, and would also include domicile by birth. (2) The Dominion Legislature has competency to legislate on matters of admission, emigration or expulsion from India under the List I, Section 100, Government of India Act, 1935.
