Summary/Remarks
It was held that even though the existing Rules at the time of the breach of her permit by the petitioner did not make breach of permit a punishment, that does not prohibit the subsequent Ordinances and Rules to charge her with the offence. She was being charged for staying in India i.e. the breach of her one month permit, even after the new Ordinances. The facts were also distinguished from Shabbir Hussain v State of U.P. [AIR 1952 All 257]
