Summary/Remarks
It was held that restrictions under Section 5 of the Influx from Pakistan (Control) Act 1949 were reasonable, considering the foreign relations with Pakistan, which requires closely , monitoring the flow of persons into India. It was also held that commission of offence under Section 5 requires a men's rea, and so the Section is not too wide in its power.
