The court held that the principle of res judicata embodied in section 11 of the Code of Civil Procedure, 1908 would not be attracted to a proceeding under the Foreigners Act and the Foreigners (Tribunals) Order. The opinion of a Foreigners Tribunal cannot be considered a judgment. It was further held that a Foreigners Tribunal can render an opinion only on the reference made to it but the ultimate decision rests with the Central Government under section 3 of the Foreigners Act.
